With so many HOA's now it can sometimes be difficult in sorting out who is responsible for the damage when it comes to water damage in an HOA controlled property so lets look at some of the facts and help you figure out where you stand on the issue. 

How do we allot responsibilty in the event of a water damage? 

When it comes to condominiums and apartments the common practice is that the tenant is responsible for the interior of the home or "...from the paint inward." and the HOA is responsible for the exterior "...from the paint outward". The questions begin to arise when a water damage started from the exterior and then permeated inward to the interior as a result of a building failure in the exterior...who holds blame here is the common questions. 

Often times the water damage can get extensively worse do to the time taken by the HOA and unit owner to discuss, bicker and point fingers neither willing to take responsibility. In this crucial time the damage expands exponentially and could potentially cause microbial growth and extensive secondary damage. 

Step 1.) Read the Contract 

When you originally got into the agreement there was a large amount of paperwork that was signed and agreed upon by both parties. Often times the answers to these disputes lie in the paperwork and responsible parties are clearly labeled and defined based on type and severity of damage. Typically the responsibility will fall on the party responsible for the exterior, especially if negligence in plumbing and roofing maitenance can be proved. 

Step 2.) Identify the Problem 

Often times in these situations the answer may come down to a technicality or a bylaw so it is imperative that you discover the source of the water damage as quickly as possible and then document it with both picture and possibly video evidence. Regardless of who is at fault it is much easier to identify the source of the damage earlier rather than later. 3.) Let Your HOA Know ASAP

When it comes to water damage inside your property there are usually a number of clues that indicate as much pretty early on in the water intrusion, in this blog we are going to discuss 6 of them that should send up red flags to a homeowners or property manager that there is moisture inside the walls and something going on that needs to be addressed fairly quickly. Many of these signs may be very noticeable to the common person unless you know what to look for and specifically what you are looking at. Some of the more common things that can pop up and indicate a problem are thing like cracks in the grout, drywall softness or cracking, nail pops, obvious structural damage, buckled cailings, buckled floors and very distinct moldy smells are all very common signals that there is an absolute moisture issue somewhere on the property. What is CAT 3 Water? This is a very common questions that we hear from our customers and clients especially following a major flood, storm or hurricane. The word CAT is short for category and there are 3 different types when it comes to water inside of a home, business or structure that we focus on. Category 1 water is originated from a sanitary or potable water source and does not pose a substantial risk if humans are exposed to it, otherwise known as clean water. Examples of category 1 water is water from water supply lines, melting snow or ice, rainwater, toilet tanks and toilet bowls without contaminants. In the case of a category 1 water damage a restoration company can realistically salvage and dry any of the affected materials including carpet, drywall, carpet padding, hard wood flooring and other porous building materials.

Category 2 water contains a significant amount of contamination and may actually cause illness or infection if exposed to it. Category 2 water can potentially contain unsafe levels of various bacteria, viruses or mold and nutrients for the microorganism and other contaminants, otherwise known as grey water. Examples of Category 2 water are washing machine / dishwasher overflow, aquariums, damaged water beds, urine filled toilet bowls and hydrostatic pressure seepage from foundation slabs. If the mold or mildew does not disappear after spray down and clean then reapply the solution and utilize light scrubbing / agitation to remove the mold or mildew from the affected area.

When you are finished clean up the entire area with the solution and throw away any rags or paper towels used in the cleanup process. Make sure when you throw these items away that they are placed in an individual trash bag and sealed or tied so as not to allow the affected materials to be removed from the bags. Our process is broken up into several phases and steps that take us through the entire process from the initial visit to final billing to the insurance carrier. 

Phase 1 consists of Project Initiation this is the initial meeting with the customer explaining our process and taking our required photos and measurements. Following this we move over to Phase 2 which is our Project Plan. This is where our crews collect moisture readings and compile a plan of action. If any necessary approvals are needed our crew would,during this phase, reach out to an insurance adjuster and obtain those additional approvals. Phase 3 then consists of actually performing the plan that was put in place by the water crew chief. The final phase it the project close out. Psychrometrics

Psychrometry is the study of the air and its properties. The properties of temperature, humidity, vapor pressure and dew point are measured to evaluate air conditions in the structure, enabling a SERVPRO® Franchise Professional to create the proper atmosphere for more efficient drying. Water can damage materials in two ways: first, by absorption through direct contact with water; and second, absorption of moisture from the air. Measuring the moisture content of the air is critical to the drying process. Restoration professionals must establish an environment favorable for drying. The restoration professional must also understand how to manipulate temperature and humidity levels to produce optimum drying conditions, without causing secondary damages through improper drying processes.

Detection Equipment

Scoping involves locating the areas of the structure affected by water and defining the extent to which the structure and contents have absorbed moisture. Moisture detection devices are also used to verify that an environment has been dried thoroughly.

  • Moisture Sensors are used to detect moisture in carpets, baseboards and walls.
  • Moisture Meters are used to determine the actual moisture content of various materials. The moisture tester provides accurate moisture readings that enable the SERVPRO® Franchise Professional to monitor the drying process.
  • Thermohygrometers measure both temperature and relative humidity. Capturing these two readings, a SERVPRO® Franchise Professional using a psychrometric chart can calculate specific humidity, dew point and vapor pressure.

Extraction Equipment

The most effective method of removing moisture from a structure is extraction. This is why it is critical to respond quickly to a water damage and to provide emergency mitigation services. When the water is extracted quickly, the environment can usually be dried much faster.

  • Extractors are used in cleaning carpets and upholstery and in removing water from floors following a water damage. Extractors can either be truck-mounted or portable, allowing for greater access inside structures.

Air Moving Equipment

Air movers are used in water damage restoration to enhance evaporation at the surface level, thereby reducing drying time. As airflow at the surface level increases, the moisture in the air increases. This moisture is then eliminated via the use of dehumidification equipment.

Dehumidification Equipment

By extracting water vapor from the air, dehumidifiers lower the relative humidity, which in turn increases the rate of evaporation. In a water damaged structure, dehumidifiers pull in the moist, humid air and then discharge dry, warm air. The dry air acts like a sponge, absorbing moisture from wet materials. SERVPRO® Franchise Professionals use two types of dehumidifiers:

  • Refrigerant Dehumidifiers work similarly to air conditioners.
  • Desiccant Dehumidifiers use chemicals, called desiccants, that readily absorb moisture from the air.

Deodorization Equipment

  • Ultra Low Volume (ULV) Foggers will atomize liquid deodorizing agents, producing a fine mist that easily penetrates sites where odor-causing residues accumulate. The device can also be used to inject fungicides and disinfectants into wall cavities and other difficult-to-access areas.
  • Thermal Foggers dispense solvent-based products in large volume, dense fogs suitable for confined areas. The fog consists of tiny particles of deodorant solution that pair with and neutralize odor-causing particles.
